“The Staffing Committee will meet monthly, on a mutually agreed to date and time, and on an ad hoc basis if necessary. The Committee will consist of four (4) NYSNA members chosen by NYSNA, paid at the straight-time rate (or released from work), and management, as well as a NYSNA rep or reps. If the union requires one or more of the affected nurses to testify or provide information, they will be paid or released as above.
The Committee will be charged to review the occurrence data and determine if a violation occurred, based on the evidence submitted. If the Committee agrees, both that a violation has occurred and what the remedy should be, based upon the list in this section, that decision will be binding.”
